A tragic car crash has happened near Bowman Field, killing a person. This one hits home for this law firm, as it is an area well known to Attorney Brent T. Ackerson, who represented that area on the Louisville Metro Council, and still represents the adjacent area.

Shirley DeFelice was killed while driving her car on Taylorsville Road, near the intersection of Kings Highway and Valletta Road. Police reports indicate that a yellow truck crossed into the lane of on coming traffic and hit a white Lincoln driven by an elder woman. The elderly woman was taken to the University of Louisville Hospital where she later died from her injuries. The driver of the yellow truck and a passenger in the white Lincoln were also taken to University Hospital with injuries.

Reports indicate that this auto accident is the fault of the driver of the yellow truck. As such, the passenger in the Lincoln will have personal injury legal claims against the driver of the truck, and the Estate of female driver of the Lincoln, who was killed due to the crash, will have wrongful death legal claims against the truck’s driver. The legal damages from accident like this that are recoverable under Kentucky law can vary from lost wages, medical bills, pain and suffering, future medical costs, and in the case of death, a loss of lifetime earning capacity claims. Even in cases of death involving an elderly person, there is still a substantial loss of earning capacity claim. Initial reports by the Kentucky State Police indicate that a 2008 Pontiac driven by a Sarah Hottell failed to stop at an intersection and struck and ambulance and then hit a Volkswagen. This Kentucky auto accident occurred in Meade County on KY 313 and KY 333. Ms. Hottell died at the scene from the accident injuries and her 10 month old infant was transported to Kosair Children’s Hospital with minor injuries.

The EMTs in the ambulance, Todd Flory and Michael Wise, were ejected from their vehicle and suffered severe injuries. They were taken to University of Louisville Hospital. The driver of the Volkswagen that was hit, Maria Williams, was taken to Hardin Memorial Hospital. From the reports, this appears to be an automobile accident caused by the fault of Ms. Hottell. As such she and her automobile insurance carrier will be responsible for the damages caused by this car crash. Ms. Williams, Mr. Flory, and Mr. Wise, will all have claims against Ms. Hottell, due to her negligence. Mr. Flory and Mr. Wise, in addition to a workers compensation claim, will be able to make a 3rd party negligence claim against Ms. Hottell’s estate and insurance coverage.

The potential problem with this accident and the chance for the victims to seek justice is that there may not be enough insurance coverage to cover all the damages. Fortunately the workers comp will help to provide coverage and there may also be additional coverage from other policies available. This is an instance where every possible policy needs to be considered, including the policies of the victims for uninsured and/or underinsured coverage.

A two car accident in Corbin, Kentucky has left at least two people injured and sent them to the hospital with injuries. Susan Vaughn, of Corbin, was a passenger in a Ford Probe driven by her husband, Michael Vaughn, also of Corbin. As they were driving toward Corbin on Hwy. 25W, a Chevrolet Malibu, driven by Wilma Jean Hoskins, of Lily, attempted to make a left turn, according to Michael Vaughn. Instead, Hoskins drove into the path of the Vaughn’s vehicle and caused the crash, according to Vaughn. The crash happened in front of the So-P-J Car Wash.

Persons injured in Kentucky car crashes are entitled to compensation and justice under Kentucky Law for the economical losses and physical injures related to accidents.

Both of the Vaughn’s were reportedly wearing seatbelts and their airbag deployed in the crash. Still, Susan Vaughn suffered injuries to her right arm and face, and was placed in a neck brace at the scene. For treatment of her injuries, she was transported to Baptist Regional Medical Center in Corbin.

It has been reported that Sherri Turner, age 39, attempted to turn her vehicle at the intersection of Hwy 80 and Add Hollow Road in Clay County, Kentucky, when her vehicle struck a vehicle in oncoming traffic. This auto accident resulted in the death of Ms. Turner, the injury of Ms. Turner’s 4 year old child, and injury to Sophia Feltner, the driver of the other vehicle.

Sunday morning around 4:00 a.m., a Mercedes and a Dodge Durango were involved in a car accident on Bardstown Road, between Watterson trail & Hurstbourne Parkway. The driver of the Mercedes was killed, the passenger of the Mercedes was injured, and the driver of the Durango has been charged with DUI. Witness report that the driver of the Mercedes clipped the Durango and lost control of his vehicle. In cases like this it is important to use an accident re-constructionist to determine what likely caused the accident and who is the at-fault party or what percentage of fault each driver bears.

In this case, it is arguable that the driver of the Durango, who was driving under the influence of alcohol, bears some fault. A two vehicle car accident on Ky 80, approximately 8 miles east of Columbia, Kentucky has resulted in the death of one driver, Travis Fair, and the injury of another driver, Daryl Flatt, and a passenger, Candi Flatt. Reports indicate that Mr. Fair’s vehicle crossed the center line of the roadway and struck the Flatt’s pickup. Mr. Fair died at the scene and the Flatts were taken to Westlake Regional Hospital to be treated for their injuries. Reports are speculating that texting while driving was a factor in this crash.

Texting while driving is illegal in Kentucky and would be a cause for a legal claim of per se negligence on the part of the texting driver. This per se claim of fault is important in helping the not at fault driver and passenger to recovery the maximum allowed damages under Kentucky law to compensate them for their injuries and this accident.

In cases where texting is suspected, it is important to quickly file legal claims so subpoenas can be issued for the cell phone records of the at fault party. Many times, depending on the cell phone company, texting records are not kept for a very long period of time. After severe weather caused the overturning of multiple tractor-trailers, traffic along the Gene Snyder was delayed. It was during this delay that a male driving passenger van failed to slow or stop and struck the rear of a red Chevy Impala, killing the elderly female passenger and injuring the elderly male driver. The impact to the Impala was so severe that it caused two other vehicles to be collided with, a Camry and Hyundai SUV. Both drivers of the subsequent collision were injured.

The driver of the passenger van will be the at fault driver in this crash. This accident will involve numerous legal claims, being three personal injury claims for the drivers of the Impala, the Camry, and the Hyundai SUV. The Estate of the female passenger of the Impala will have a Kentucky Wrongful Death claim. Because of the severity of the accident, injuries, and the death, insurance coverage may become an issue in these matters.

Joe Herndon, age 19, was killed Saturday in a fiery single car auto accident. Reports indicate that Mr. Herndon’s car was traveling west on Ky. 2168 when it left the road and hit an embankment and then a tree. When police arrived, the car was engulfed in flames. Our sympathies go out to the Herndon family in their time of lose. It is still undetermined if something caused this tragic wreck or if some factors played a role in the wreck occurring. When collateral factors play a role in a accident or death, there can be legal recourse for the victim or the victims family.

Thomas Redden, age 28, of Dawson Springs, Kentucky was killed in a fatal DUI crash. Redden was a passenger in a pickup truck driven by Jeffrey Alfred. The pickup truck lost control, left the road and struck a tree. The driver was not injured and fled the scene without rendering assistance to Redden. Redden was taken to Caldwell County Medical Center where he died from his injuries. The driver of the pickup, Alfred has been charged with DUI and now face homicide charges. The single vehicle Kentucky auto accident happened on Kentucky 672 approximately 8 miles east of Princeton, Kentucky.

Mr. Redden’s family and Estate will have a Kentucky Wrongful Death claim stemming from this tragic accident.

Kentucky Police have reported that a serious car accident that happened on I-64 in Harrison County, Kentucky is due to a minivan backing up in an attempt to make a u-turn. The car crash happened on Interstate 64 near mile marker 101. Gina Lee, age 34, of Henderson, Kentucky was driving a minivan when she came to a stop in the inside lane of westbound traffic, drove the van in reverse, attempting to return to a u-turn spot in the median. The Minivan was struck in the rear by a woman from Missouri who was driving a Toyota Prius. The woman from Missouri was taken to the hospital with injuries. Ms. Lee was STAT flighted to UL Hospital. Michael Lee, age 28, of Madisonville, Kentucky was a passenger in the van and was taken to Floyd Memorial Hospital form his injures. A 15 year old girl was asleep in the rear of the minivan and was taken to Kosair Children’s Hospital for her injures.

The female driver of the Prius, from Missouri, will have legal claims for her injuries from this accident. Mr. Lee, the passenger in the van, and the 15 year old girl in the back of the van, will also have legal claims to recovery their damages. This accident appears to clearly be the fault of Gina Lee.
