An update from our previous posting about the tragic accident that took the life of 5 year old Blake Cohorn. (Clink Here for link to previous post).
The Cohorn Family was involved in a head on traffic accident, in which Blake was killed and his parents were both injured. The Cohorn Family has medical expenses, funeral expenses, and other expenses that directly relate to this tragic accident that was caused by a drunk driver, who was driving without a license. Additionally, the family, being injured from the accident has lost wages and bills that now will be difficult to pay due to the lost income from being injured.

The Cohorn family was traveling from Indiana when the vehicle they were in was hit head-on by a drunk driver. The Kentucky car crash happened on U.S. 60 in Woodford County, Kentucky around 10:00 p.m. last Sunday. Alfonso Diaz-Diaz, age 26 was traveling west in the eastbound lane and struck the Cohorn’s vehicle. Mr. Diaz-Diaz has been charged with multiple criminal counts, including DUI and Manslaughter.

Tragically, the car crash killed 5 year old Blake Cohorn and seriously injured Blake’s mother, Wendi Gohorn, and Blake’s father, Rocky Cohorn, Both of whom are presently being treated at UK Hospital. Blake’s two siblings were treated and released from medical care, and are fortunately not seriously injured. Blake’s uncle, Danny Cohorn, was treated for head and facial injuries at Frankfort Hospital.

Not only will Mr. Diaz-Diaz be subject to criminal prosecution, but the Cohorn family can also seek civil justice under Kentucky law for the death of Blake Cohorn and the personal injuries suffered by the other family members hurt in the auto accident. The Cohorn’s are suffering the personal loss of Blake’s life and suffering financially from this tragedy. Under Kentucky law, the Cohorns can seek civil compensation for their damages from this accident, which will include lost wages, medical bills, pain & suffering, out of pocket expenses, and emotional trauma. Not only will the family have Kentucky civil personal injury claims, but they will also have a Kentucky Wrongful Death claim.

Moped and motor scooter riders in Kentucky have many of the same legal rights as car drivers under Kentucky Law, when it comes to motor vehicle accidents. However, the protections can vary, especially depending upon the type of moped or scooter being ridden and the insurance coverage available.

The photo herein may not seem like too serious of an accident, but the scooter’s driver and passengers in these types of wrecks are thrown from the vehicle and usually suffer severe injuries. In this photo, it appears that the driver of the SUV turned in front of the scooter and failed to yield it the right of way as it traveled straight on the road.

A multicar accident in Bullitt County, Kentucky has injured three people. The wreck happened just before noon on Monday in the Mount Washington area along Highway 44. The injured persons were all taken to UofL Hospital. Persons injured in Kentucky auto accidents have legal rights under Kentucky Law. Zachary Inman, age 19, of Kevil, was injured in a Kentucky car accident after another driver failed to yield the right of way. Inman was driving eastbound on US 60 when a vehicle traveling southbound on Maxon entered the intersection of US 60 and failed to yield the right of way to Inman’s vehicle. Inman was taken to the hospital for his injuries. Inman will be entitled to seek legal compensation for his damages suffered from this accident. Mary Casebier, age 50, of Louisville, Kentucky was injured Thursday morning in a car crash on I-71 in Oldham County. The accident happened around 7:44 a.m. after a car traveling south on I-71 crossed the median of the expressway and struck Ms. Casebier’s Jeep. Ms. Casebier was taken from the accident to UL Hospital. This unfortunate Kentucky auto accident clearly is not the fault of Ms. Casebier. As such, Kentucky law will afford Ms. Casebier legal recourse for the damages she has suffered, including lost wages, medical bills, and compensation for her pain and suffering.

An two pickup crash injures an innocent driver in Paducah. Andrew Hobbs, age 24, of Paducah, Kentucky, was injured after the pickup he was driving was hit head on by another truck driven by a driver charged with a DUI. The crash happened at 9:00 a.m. Wednesday on Old Mayfield Road. The driver charged with the DUI was also charged with driving on a suspended/revoked license.

While this is a strong case of liability on the other drivers part, this will be a complex legal matter for Hobbs, as insurance coverage may be limited due to the nature of this accident. Experienced attorneys will know to look for extended insurance coverage so as to try to maximize the legal recovery Hobbs will be entitled to under Kentucky Law.

A motor vehicle accident in Estill County, Kentucky has left 2 innocent people dead. William Neal was driving his SUV when a vehicle driven by an 18 year old over corrected her driving and entered Mr. Neal’s lane of traffic. William Neal died at the scene of the crash and his passenger, Ronald Whitaker, died at the hospital following the crash. This tragic accident was not the fault of Mr. Neal or his passenger Mr. Whitaker. As such, Kentucky law will afford the families of both Mr. Neal and Mr. Whitaker justice. Those families will be able to make a Kentucky Wrongful Death claim against the parties at fault for this tragic accident. The legal monetary damages will be large and include pain and suffering, medical bills and expenses, funeral expenses, and a calculation of the lifetime lost earning capacity of these 2 men.

Monday night in a crossover accident on Winchester Road near Man O’ War has sent a woman to the hospital with serious injuries. The accident happened after a pickup truck crossed the center line on Winchester Road and hit a minivan head on. This was a serious Kentucky auto accident, as seen from the picture herein. The injured woman and her family have rights under Kentucky law related to this Lexington car crash. Also in the minivan were a man and three children.

A fatal accident involving a moped and a SUV has resulted in the death of a 27 year old man, Benjamin Johnston. The motor vehicle accident occurred at an intersection on US-23 in Greenup County. Mr. Johnston was riding a moped and attempting to turn make a turn, when according to police, Jamie Miller in an SUV ran a red light and hit Johnston. Mr. Johnston was taken to the hospital where he died from his injuries. Miller is suspected, according to reports, of being intoxicated.

This is a tragic loss of life, which may be even worse if intoxication is a factor. The Johnston family has legal rights related to the death of Benjamin Johnston. The family may be able to proceed with a Kentucky Wrongful Death civil lawsuit against Mr. Miller and potentially others. In cases where intoxication is involved, it is important to establish an earlier legal investigation by an attorney of the facts so that evidence is not lost. Its important to fully examine all possible legally responsible persons and/or all parties who might have some, even if small, percentage of responsibility.
